Involving cannabis industry players in marijuana testing could help U.S. states address testing lab fraud, scientist David Vaillencourt says. Testing is critical to ensuring the cannabis products entering the U.S. market are free from potentially harmful contaminants like heavy metals, residual solvents, and bacteria. However, data has consistently shown that America’s state-approved cannabis industry is awash with untested products.
In late 2024, a state-approved cannabis operator in Colorado ran a series of tests on retail cannabis products purchased in licensed marijuana stores from the Denver area, revealing something shocking: the majority of the products violated state health and labeling standards. Most of the other states with legal cannabis markets are also filled with products that don’t meet labeling and safety standards, indicating a clear deficiency in cannabis testing protocols.
Improved cannabis testing will be key to increasing consumer trust in cannabis players and ensuring licensed cannabis retailers do not risk their customers’ health. However, in addition to a prolific black market that has flooded the U.S. with substandard and often unsafe goods, testing lab fraud also undermines the industry’s integrity.
There has been a significant number of marijuana testing labs involved in fraud-related scandals in recent years, indicating the need for more testing-related regulation. Vaillencourt notes that the recent surge in testing lab scandals is mostly due to several laboratories conducting their duties of collecting and summarizing cannabis testing-related data extremely efficiently.
The scientist says outfits like the Massachusetts-based MCR Labs are providing in-depth information to the public and inadvertently shining a light on America’s pervasive cannabis testing lab issues.
As an increasingly larger portion of the U.S. market clamored for high THC products, cannabis firms started shopping for testing labs that provided more ‘favorable results.’
Labs that provide accurate results are less likely to attract business, especially if these results lower the value of a cannabis company’s products. Customers ultimately pay the price by being exposed to products that contain more or less THC than they claim on their labels. Since this is an industry-wide issue, tainted products that could potentially harm customers’ health have a significant chance of ending up on the shelves.
The solution would require collaboration with cannabis industry players as well as a standardization strategy that doesn’t stifle innovation, Vaillencourt says. A standardized testing framework with minimum performance standards would make it difficult for companies to skew the results in their favor. Such standards could cover how the cannabis samples are chosen as well as the precision and accuracy needed for lab results.
The entire marijuana industry, including entities like Tilray Brands Inc. (NASDAQ: TLRY) (TSX: TLRY) would be comfortable seeing testing lab fraud stamped out so that the growth of the industry can proceed without scandals of this nature blighting its image.
